Over the last 10 years, there have been numerous legislative attempts in Massachusetts to limit - and in some cases do away with - non-compete agreements. All of them have stalled, and the law in this area remains largely judge-made. However, in recent months, several bills have been filed that appear to have a significant amount of overlap, suggesting that 2018 may be the year that a consensus emerges around comprehensive legislative reform when it comes to enforcement of these post-employment restrictions.
